Welcome to PetFriendly.com (the "Site"). By accessing or using the Site, you agree to these Terms of Use (the "Terms"). These Terms contain important legal obligations, including an ARBITRATION CLAUSE AND WAIVER OF CLASS ACTION. If you do not agree to these Terms, you must refrain from using the Site or its services.

The terms "we," "us," "our," and "PetFriendly" refer to PetFriendly.com. "You," "your," and "user" refer to the individual accessing or using the Site.

We may modify these Terms at any time. Changes will take effect immediately upon posting, and your continued use of the Site constitutes acceptance of the updated Terms. If you object to any changes, you must discontinue use of the Site.

Using the Site

The Site is provided for personal, non-commercial use. By using the Site, you warrant that:

  1. You are at least 18 years old and have the legal authority to enter into a binding agreement.
  2. All information provided by you is accurate and truthful.
  3. You are financially responsible for all uses of the Site under your account, including those by others.
  4. You will only make legitimate bookings for yourself or others for whom you are legally authorized to act.

We reserve the right to deny access to the Site or its services at our discretion.

What We Do

PetFriendly.com connects users with pet-friendly accommodations. We partner with hotels and other accommodation providers ("Accommodation Suppliers") to showcase properties suitable for traveling with pets.

PetFriendly.com serves as an intermediary platform and does not own, manage, or control the accommodations listed. Bookings are subject to the Accommodation Supplier’s terms and conditions, which you must review and accept before completing a reservation.

Accommodation Policies and Pet Fees

Accommodation Suppliers have unique pet policies. While most partners accept up to 2 dogs of 75 lbs each, additional restrictions may apply. Failure to meet these requirements may result in the cancellation of your reservation without a refund.

Suppliers may charge refundable pet deposits or enforce rules regarding noise, leashes, and pet relief areas. Compliance with these policies is your responsibility, and non-compliance may result in forfeited deposits or eviction from the property without reimbursement. PetFriendly.com is not liable for any actions taken by Accommodation Suppliers due to policy violations.

Service Animals and Emotional Support Animals (ESA)

Service animals are exempt from pet fees under U.S. law. For ESAs, we work with Accommodation Suppliers to request fee waivers, though these are not guaranteed and are subject to supplier discretion.

Additional Charges

Additional charges such as refundable pet deposits or resort fees may apply and must be paid directly to the Accommodation Supplier.

Prices are quoted in USD and may vary due to currency exchange rates or supplier changes. Errors in pricing will be corrected, and you will have the option to accept the revised price or cancel.

Cancellations and Modifications

Cancellation and modification policies vary by Accommodation Supplier. Failure to adhere to these policies may result in fees or forfeited payments. Non-refundable service fees will not be reimbursed.

Dispute Resolution and Arbitration

Any disputes arising from these Terms or use of the Site will be resolved through binding arbitration in Texas, under the rules of the American Arbitration Association. Class action waivers apply. You may bring individual claims in small claims court if eligible.

Force Majeure

PetFriendly.com is not liable for disruptions caused by events beyond its control, including natural disasters, pandemics, government actions, or supplier insolvency. Refunds in such cases are at the discretion of the Accommodation Supplier.

Prohibited Uses

You agree not to:

  • Use the Site for unlawful or unauthorized purposes.
  • Access the Site using automated tools (e.g., bots, scrapers) without permission.
  • Violate the intellectual property rights of PetFriendly or third parties.
  • Overburden our systems or attempt to interfere with the Site’s functionality.

We reserve the right to restrict access for violations of these Terms.

Intellectual Property

All content on the Site, including text, images, logos, and software, is owned by PetFriendly.com or its licensors. You may not reproduce or distribute this content without prior written consent, except for personal, non-commercial use.

Disclaimer of Liability

If PetFriendly is found liable for any loss or damage that arises out of or is in any way connected with your use of the Website, then PetFriendly’s liabilities will in no event exceed, in the aggregate, the greater of (a) the commission fees paid to PetFriendly for the transaction(s) on this Website giving rise to the claim, or (b) One-Hundred Dollars ($100.00 USD).

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of PetFriendly.

Jurisdiction and Governing Law

This Website is operated by a U.S.-based entity, and this Agreement is governed by the laws of the State of Texas, USA. By using this Website, you consent to the exclusive jurisdiction and venue of courts located in Texas and agree that such courts are a fair and convenient forum for resolving any disputes arising out of or related to your use of the Website.

You further agree that all claims or disputes you may have against PetFriendly.com must be resolved in a court of competent subject matter jurisdiction located in Dallas County, Texas. Use of this Website is unauthorized in any jurisdiction that does not give full effect to these terms and conditions, including, but not limited to, this provision.

General Provisions

No joint venture, partnership, agency, or employment relationship is established between you and PetFriendly.com as a result of this Agreement or your use of the Website. PetFriendly.com retains the right to comply with legal obligations and respond to law enforcement or governmental requests related to your use of the Website, and nothing in this Agreement limits that right. Any claims or causes of action arising from your use of the Website must be filed within one (1) year from the date they arise or they will be permanently waived.

If any provision of this Agreement is found to be invalid or unenforceable under applicable law, it will be replaced by a valid provision that reflects its original intent, and all remaining provisions will remain in effect. No action or inaction by PetFriendly.com constitutes a waiver of any provision of this Agreement unless explicitly stated in writing. Notices related to the Website may be sent to your last known email address and will be deemed received on the day they are sent.

This Agreement represents the entire understanding between you and PetFriendly.com regarding your use of the Website, superseding all prior communications or agreements. It may be presented in printed or electronic form in legal proceedings. If this Agreement is terminated, any provisions that should reasonably survive termination will remain in effect. Fictitious names, entities, or data mentioned on the Website are not intended to represent actual individuals, companies, products, or events.

Any rights not expressly granted under this Agreement are reserved.

Copyright Complaint Policy

If you believe in good faith that material hosted on PetFriendly.com infringes your copyright, you may submit a notification to us with the information outlined below. This procedure is exclusively for notifying PetFriendly.com of alleged copyright infringement.

Infringement Notification

To submit a claim, please provide the following information:

  • Identification of the copyrighted work: Clearly describe the copyrighted work you believe has been infringed. If available, include the URL or other specific location of the material.
  • Identification of the infringing material: Provide detailed information about the material you claim is infringing, including its location on the Website (e.g., URL or link).

If material you have posted has been removed due to a copyright complaint, you may file a counter-notification if you believe the removal was a mistake or that the material was misidentified. To submit a counter-notification, include the following:

  • Identification of removed material: Clearly describe the specific content that was removed or disabled and the location where it appeared on the Website (e.g., URL or link).
  • Your contact information: Provide your name, mailing address, telephone number, and email address.
  • Jurisdiction consent: “I consent to the jurisdiction of the Federal District Court for the judicial district of Dallas County, Texas.“
